Is the driver’s liability covered by the advertiser’s insurance?

In Spain, civil liability towards third parties is covered by the provisions of Article 6 of Royal Legislative Decree 8/2004 of 29 October, which approves the recast text of the Law on Civil Liability and Insurance in Motor Vehicles. This article 6 orders the unavailability of the insurer in damages against third parties. The Act provides that the insurer may only object to the coverage of damage suffered in the insured vehicle itself or in the driver himself who caused the accident. The company may not object to the coverage of damage caused by a vehicle against third parties, regardless of the agreements included in the policy. 

Third-party liability will therefore be covered by the advertiser’s compulsory insurance policy.
